Description
This is an action for divorce. The plaintiff husband, age fifty-two, and the defendant wife, age forty-nine, were married on August 19, 1940, neither party having been previously married. The parties have three living children: Michael, age fourteen; Mary Ann, age twelve; and Margaret, age seven. The parties had two other children -- Bonnie Lee who was killed in an accident in 1956, and John, Michael's twin, who died at the age of two in 1953. The plaintiff is employed as a deputy scout executive for the Boy Scouts of America in Milwaukee. His take-home salary is about $750 per month. This action was commenced by the plaintiff, Dayton Newton, on April 28, 1965, by service of a summons on the defendant wife. On July 22, 1965, a complaint was served, and on September 16, 1965, an answer was served. The answer generally denies the allegation of cruel and inhuman treatment, and does not assert any affirmative defense or counterclaim; it requests no affirmative relief, but merely requests dismissal of the action.
